These Terms of Service ("Terms") govern your access to and use of RiskBeforeBuy (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By accessing or using RiskBeforeBuy, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
RiskBeforeBuy aggregates publicly available federal datasets to provide property risk intelligence, including flood, wildfire, earthquake, and crime risk estimates, along with a 30-year net present value (NPV) cost model. The Service is informational only.
Our risk estimates are derived from federal and public datasets (FEMA, USGS, NOAA, USFS, FBI UCR, U.S. Census) that are updated on their own schedules. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party sources.
Risk estimates are probabilistic, not guarantees. A low risk score does not mean a property will not experience a disaster. A high risk score does not mean a property will experience one. The NPV model uses assumptions about discount rates, event frequencies, and loss magnitudes that may not reflect actual future conditions.
Always consult qualified professionals — including licensed real estate agents, insurance brokers, structural engineers, and financial advisors — before making property purchasing decisions.
You may use the Service for lawful personal or commercial research purposes. You agree not to:
Pro plan subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.
Paid plans are billed monthly or annually in advance. All fees are in U.S. dollars and are non-refundable except as required by applicable law or as expressly stated here. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may change pricing with 30 days' notice.
The free tier provides county-level summaries and is subject to rate limiting. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
The Service, including its design, methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying government datasets are in the public domain. Our original expression, analysis, and NPV methodology are proprietary.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Smart Technology Investments LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property or confidential information.
We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account by canceling your subscription and ceasing use of the Service.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service and supersede all prior agreements or understandings.
